'Notice to Fix' issued on old Angus Gemmell building

Council will issue a “notice to fix” to the owner of the old Angus Gemmell building after inspectors assessed the site and determined that the awning out front is unsafe.

Council’s chief executive Steven May says as a result of an inspection, he has authorised a “notice to fix” to be placed on the building to ensure the safety of the community.

A notice to fix is a statutory notice requiring a person to remedy a breach of the Building Act 2004 or regulations under the Act.

The area underneath the awning is set to be fenced-off this week.

This will cause the footpath to be blocked, but Council has establish a walk-around path for pedestrians.

“Council is working with the owner regarding this matter and they will be notified with a set time for the structure to be made safe,” Mr May says.

“Council will try to minimise the disruption to the community as much as possible, but Council has a statutory obligation to ensure compliance.

“In extreme cases, if the owner does not comply with a notice to fix, then Council can do the work and the costs sent on to the building owner.

Council’s sole aim in this exercise is to ensure the safety of our community.”
