Notice is given under Section 19ZA of the Local Electoral Act 2001 (LEA) that electors of the Wairoa District have a right to demand under Section 19ZB of the LEA a poll on the question of whether:
- the district should be divided into 1 or more Maori wards
On 8 November 2011 the Council resolved:
"That under Section 19Z of the Local Electoral Act 2001 Council does not divide the district into 1 or more Maori wards for electoral purposes and that Council holds a poll under Section 19ZD of the Local Electoral Act 2001 on the question of whether or not to divide the district into 1 or more Maori wards for electoral purposes as part of the 2013 local government elections to be held on 12 October 2013."
This resolution can only be countermanded by the result of an earlier poll of Wairoa District electors.
To be valid, any demand for a poll must be made in accordance with Section 19ZC of the LEA. It must be made in writing and be signed by not less than 264 electors (being 5% of the number of electors enrolled for the 2010 elections). It must be delivered office of the Wairoa District Council, Queen Street, Wairoa.
Every elector who signs such a demand must also set out in it his or her full name and the address for which he or she is qualified as an elector of the Wairoa District Council. If a valid demand is received by 28 February 2012, the poll will have effect for the 2013 and 2016 local authority elections. If it is received after 28 February 2012, the poll will have effect for the 2016 and 2019 elections.
