Land Use Consent

The Wairoa District Plan allows, controls or prohibits land use activities in the district.  Those activities, which may result in adverse effects on the environment, are addressed in the District Plan and you will require a resource consent to establish these activities.


To establish a controlled, discretionary or non-complying activity you must apply to Council for a resource consent.  Such applications will then be considered by Council and will either be granted with or without conditions, or declined.  If resource consent is granted then you can establish the activity you applied for.


How do I apply for a Land Use Consent?
You need to complete a Land Use Consent Application Form.

You may also need to complete an Approval From Affected Persons Form

Section 96 of the Resource Management Act 1991 provides:   
 
(1) The following persons may make submissions to a consent authority about an application for a resource consent:

(a) if the application is publicly notified in accordance with section 93 or section 94C, any person:

(b) if notice of the application is served under section 94(1), any person served with the  notice of the application.

(2) A submission must be in the prescribed form and served on the local authority.

(3) A submission may state whether it is in support of, or in opposition to, the application [or is neutral].

(4) A person who makes a submission shall serve a copy of it on the applicant as soon as reasonably practicable after serving the submission on the consent authority.
